509Ticket Services And Roles.
- 1 What We Do: We operate an events management and growth platform designed to facilitate thriving connections between organizers and consumers through memorable live experiences. Our services empower organizers to create, post, and manage both online and in-person events. Organizers can utilize our platform to sell tickets, gather donations, and maintain a strong connection with consumers through a suite of marketing tools.
- 1.2 How We Fit In: We emphasize that we are not the creators, organizers, or owners of the events listed on our platform, nor are we the direct sellers of tickets, registrations, or merchandise. Instead, we offer services that enable organizers to efficiently manage ticketing, registrations, and event promotion.
- Organizer Responsibility:
- The primary responsibility for event compliance with applicable laws and regulations rests with the organizer. This includes ensuring that the goods and services described on the event page are delivered accurately and satisfactorily.
- Payment Processing:
- If an organizer is hosting a paid event, they have the autonomy to choose the payment processing method made available to consumers, as described in our Tems.
- Organizer Responsibility:
- Fees and Refunds: 1.1 We apply the following fees. While creating an account is free, fees are charged for the purchase/sale of paid tickets. These fees may vary based on agreements with specific organizers. Organizers may decide whether to pass these fees to consumers or absorb them into ticket prices. Consumer fees may include facility fees, royalties, taxes, processing fees, and fulfillment fees. It’s important to note that consumer fees may differ from those charged to organizers or the standard fees described on the platform. Additionally, certain fees aim to cover costs but may include elements of profit or loss. We do not control or disclose fees imposed by banks or credit card companies. Please check with your bank or credit card company for details on applicable fees, surcharges, and currency conversion rates.1.2 Ticket Transfer: Should you wish to transfer tickets, please contact the event organizer directly to facilitate the transfer.1.3 Refunds: Consumers seeking refunds should contact the event organizer. Refunded tickets must not be used, and organizers should not accept invalid tickets. As transactions are between organizers and consumers, we request consumers to direct refund requests to the respective event organizer. If a refund is received, consumers must not use the ticket to attend the event, as doing so constitutes fraud. Organizers must adhere to the proper ticket validation procedures, including using the 509Ticket app for organizers.
- Licenses and Permits Organizers Must Obtain: Organizers are required to obtain all necessary licenses, permits, and authorizations for their events. By representing and warranting that they will secure the required licensure before commencing ticket sales, organizers commit to compliance with all applicable laws, regulations, rules, and ordinances. Organizers must maintain the necessary licensure throughout their use of the platform and promptly provide evidence of licensure upon our reasonable request.
- Your Rights to Submit a Copyright Takedown Notice: In cases of alleged copyright infringement on the platform, copyright owners or their agents can submit a notice pursuant to the Digital Millennium Copyright Act (DMCA).
- Scraping or Commercial Use of Site Content is Prohibited: Users are prohibited from using site content for commercial purposes and may not scrape, crawl, or employ any automated means to extract data from the platform.
- Your Account with 509Ticket: 5.1 When creating an account, users must provide accurate information and adhere to specified rules. Users must be at least 18 years old, or the legal age of majority, and agree to maintain the confidentiality of their accounts. Account owners are responsible for any activities under their accounts and must immediately report unauthorized use or security breaches.
- Modifications to the Terms or Services: We may modify these Terms from time to time and will notify you of material changes. We reserve the right to modify these Terms (including the Privacy Policy) from time to time (collectively, “Modifications”). If we believe any Modifications are material, we will let you know by one (or more) of the following methods:A. posting the changes through the Services; B. updating the “Updated” date at the top of this page; or C. sending you an email or message about the Modifications. 8.1 Modifications that are material will be effective ten (10) days following the “Updated” date, unless a different date is communicated in our notice to you. All other Modifications will be effective immediately. 8.2 You are responsible for reviewing any Modifications. Your continued use of the Services after any Modification will be considered your acceptance of that Modification and the updated Terms. In certain circumstances, we may seek a Modification to these Terms that will only apply to you. This type of Modification must be in writing and signed by both parties (you and 509Event). 8.3 We are constantly evolving our products and services to better meet the needs of our Users. Because of this, we cannot guarantee the availability of certain product features or functionality. We reserve the right to modify, replace, or discontinue any part of the Services or the entire Services at any time and for any reason.
- Assignment: We can assign rights and obligations under these terms without user consent, in connection with corporate transactions or otherwise.
- Entire Agreement: Except as otherwise stated in these Terms, these Terms are the entire agreement between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, proposals, discussions, or communications between you and 509Ticket on the subject matter of these Terms, other than any written agreement for Services between you and us relating to a specified event or events.
- Feedback: Users grant the platform the right to use any feedback provided. Feedback may be used for various purposes, and users waive moral rights associated with its use.
- Your Content and Your Trademarks: Users grant licenses to use their content and trademarks for specified purposes. Users represent that they have the authority to grant such licenses and ensure compliance with applicable laws.You represent that you are able to grant us the rights described above.You represent and warrant that you have all the rights, power and authority necessary to grant the foregoing license, and that all Your Content and Your Trademarks:
- do not infringe, violate, misappropriate or otherwise conflict with the rights of any third party;
- comply with all applicable local, state, provincial, national, and other laws, rules and regulations; and
- do not violate these Terms.
- Your Content must be accurate and truthful. We reserve the right to remove Your Content from the Services if we believe that Your Content or Your Events violate these Terms, or for any other reason. Your Content and Your Trademarks may be displayed on the Services in proximate distance to any Site Content or any third-party content, including content that is substantially similar or competing with yours, and we do not guarantee your exclusivity as an Organizer in any category. Without limiting the generality of the foregoing, the Services are provided on a nonexclusive basis. We may preserve Your Content, Your Trademarks, Registration Data, and all other data associated with your account, and may also disclose Your Content, Your Trademarks, Registrations Data, and all other data associated with your account account if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:A. comply with legal process;B. respond to claims that any of Your Content or Your Trademarks violate the rights of third parties;C. enforce or administer these Terms; and/orD. protect the rights, property, and/or personal safety of us, our Users and/or the public, including fraud prevention.You understand that the technical processing and transmission of the Services, including Your Content and Your Trademarks, may involve transmissions over various networks and/or changes to conform and adapt to technical requirements of connecting networks or devices.
- Additional Miscellaneous Provisions: Various provisions cover waiver, enforcement, translations, and other legal aspects, including the platform’s right to modify terms and services.
